General Terms and Conditions of Sales

The general terms and conditions of sales detailed below apply to any orders submitted to Coralie Généreau-Saurou for all products and services offered on the website business-style.fr. These are permanently accessible on the Website. Coralie Généreau-Saurou reserves the right to adapt or modify at any time the general terms and conditions of sales. Their updated version will always feature on the website http://business-style.fr at the moment of purchase. Consequently, by placing an order, the buyer implies complete compliance with these general conditions of sales.

 

Article 1 – Customer

 

While feeling in personal data, the customers must ensure that the information about them is accurate. In case of error in the information given by the customer, Coralie Généreau-Saurou could not be held responsible for failure in delivery.

 

Article 2 – Product

 

The products offered for sale are those mentioned on the website at the date at which the customer consults the website, within the limits of the available stocks. As these are all single products, there is only one possible size and colour for each of them. The information provided by the Website regarding the possible previous restoration or accident that would have affected the product are expressed to facilitate its inspection by the potential buyer, and remain submitted to their own personal judgement. Coralie Généreau-Saurou presents and describes the products with the greatest care in order to best inform the customer. However, possible unsubstantial mistakes could appear on the Website, which the customer recognizes and accepts as a possibility. In the case of the non-compliance of the product delivered from its description on the Website, the Customer may either exercise its right to withdraw, or implement the guarantee of conformity ensured by Coralie Généreau-Saurou who will refund, if needed, part or total of the price billed.

 

Article 3 – Purchase

 

The purchase of goods on the Web Site is subject to compliance with the procedure set up by Coralie Généreau-Saurou. For this procedure to be ensured the customer must follow different steps in order to validate their purchase.  All orders confirmed by the Customer imply the acceptance of the sale contract and mean acceptance of all provisions hereof. The details of the order will be sent to the Customer at the same time as the purchased product(s). At all events the invoices are available in the section “my account” of the Web Site.

 

 Article 4 – Prices and Terms of Payments

 

The prices of the products are given in Euros, excluding shipping costs.

The total price of the order (taxes and shipping fees included) is stated in the basket.

The products are exempted from the application of VAT according to Article 293B of the General Tax Code.

Concerning exported orders, prices are considered Free On Board from Paris. 

The Customer will assume clearance, or the payment of any other fees or taxes.

Coralie Généreau-Saurou reserves the right to change the prices at any time, but products will be invoiced on the basis of the rates in force at the time of the check-in of the order. However, this is subject to the availability of the product. The products are payable at the order, on the day of purchase. The selection of the product(s) is done online, on the Web Site, as is the payment.

 

The following are the only methods of payment accepted:

 

·       Paypal : With Paypal your financial informations are not communicated to Coralie Généreau-Saurou  PayPal encrypts and protects your bank card number once and for all. Pay online by simply indicating your email address and password. 

 

·       Cheque (only if you reside within Metropolitan France or in the French Overseas Department and Territories). The cheque is payable to BUSINESS STYLE. In case of the presentation of an ordinary cheque, only the encashment of the cheque will be considered.  Business Style reserves its right to deliver the product only once the encashment of the cheque is done. The data recorded and kept by business-style.fr constitute the proof of the order and of all the transactions carried out. The data recorded by PayPal or the Web Site constitute the proof of all financial transactions.

 

 

Default of Payment

Business-style.fr reserves its right to refuse the carrying out an order or to answer to an order coming from a customer who would have not fully paid off a previous order, or with whom an on-going payment dispute would still be at work.

In case of litigation, the consumer may consult the rules about the European online consumption UE n° 524/2013. The European platform to solve the litigations is available at the following address :

Verification of payments

Business-style.fr checks all orders that have been validated on the Web Site. The purpose of these checks is to protect the Web Site from the abusive practices of scammers. Our office may ask you to provide us with any type of information required to unfreeze your order: Proof of address or debit to your name, or proof of address of the person mentioned on the delivery address, etc. These questions will be asked through e-mails:

 

- For an order with a delivery address different from the billing address.

- For new customers

- For any orders exceeding 100 euros

 

Article 5 – Delivery

 

Deliveries are ensured by the Postal service, from Monday to Saturday, and depending on the option chosen by the Customer during the validation of their order.

The delivery is made at the delivery address indicated by the Customer. This address must be their own, or a natural person’s address, or a legal person’s address (delivery to a company).

The delivery cannot be carried out in hotels or in postal boxes. To ensure that deadlines are observed the Customer must make sure to communicate the exact and complete information for the delivery address (such as, particularly: street number, building number, stairs, access codes, names and entry, phone numbers)

 

 

 

The given delivery times are indicative; they correspond to average delivery times. Coralie Généreau-Saurou could not be held responsible for the consequences due to any delay, as the dispatch of the products is not her responsibility.

 

All products are sent from France.

Metropolitan France and Monaco:

 

Participation to shipping costs is as it follows:

For an order which amount is less or equal to 200 € : 8.5 €.

Shipping costs are offered for orders higher than 200€

 

 

Outside Metropolitan France  and Monaco (=the French Overseas Department and Territories / Corsica / Andorra / States of the EEC) :

For a order which amount is less or equal to 300 € : 16€.

Shipping costs are offered for orders higher than 300€.

Delivery time

 

National delivery time  (Metropolitan France and Monaco) :

Under 5 working days after receiving payment.

International delivery time + French Overseas Department and Territories

Under 7 working days after receiving payment. 

 

Article 6 : receipt

 

IMPORTANT INFORMATION CONCERNING THE RECEPTION OF YOUR PARCEL

 

Checking the state of your parcel when receiving it :When receiving your parcel, you must open and inspect your package in the presence of the delivery person to see if the products are damaged (traces of shock, burns, traces of water, damaged cartons ... ). When the delivery person asks you to sign the delivery note, they cannot deny you the right to verify the contents of the parcel.

In the case of a damaged, or incomplete, delivered order: Refuse the delivery and mention it on the delivery form by indicating :

Reserves justifying refusal of delivery (indicate what is broken, crushed, destroyed, etc.), in case of damaged goods.

Reporting missing elements in the case of an incomplete delivery.

References such as " subject to unpacking " will not be accepted. No support (repayment) may be taken into account in the absence of specific reservations.

 

 

 

Article 7 – Returns and Refunds

 

The Customer may request a refund within 14 days after receiving their order. The return of the product(s) is the responsibility of the Customer and is at its own risk. The product(s) must be returned in its (their) original packaging, in its (their) original condition, unwashed.

Repayment of products is done after receipt if:

- Undamaged. No refund in case of damaged product.

- Unstained. In case of soiling, the amount of € 60 will be deducted from the reimbursement of costs.

- Given back in its packaging (when it is originally present Ex: box, pouch for bags / shoes.). Shipping costs are not reimbursed, neither when sent nor when returned. REFUND WILL BE OF THE PRECISE AMOUNT OF PURCHASE, the buyer and seller making theirs any associated costs (commission for the seller, and shipment for the buyer). To make a return, the customer must follow the instructions on the Web Site and send an email to contact@business-style.fr.

 

Return shipping costs are the responsibility of Coralie Généreau-Saurou if the delivered product is different from the ordered or damaged product. Coralie Généreau-Saurou will not make the refund of products concerned if the Customer does not respect these conditions, including conditions of return.

 

The provisions of these terms and conditions are independent of each other. The invalidity of any provision shall not render inapplicable others. Article 9 - legislative and judicial skills . Only French law governs these terms and conditions of sales. Any dispute regarding their existence, validity, enforceability, any purchaser, and their performance will be determined by the court having jurisdiction of Nanterre (92 - France ) .

 

Article 8- Independence of Provisions

 

The provisions of these terms and conditions are independent of each other .The invalidity of some of these provisions shall not render others inapplicable.

 

Article 9 – Legislative and Jurisdictional competences

 

French law alone governs these terms and conditions of sale. Any dispute regarding their existence, their validity, their enforceability on any purchaser, and their execution will be determined by the competent court having jurisdiction of Nanterre (92 - France ) .

 

Article 10 – Guarantees and Liability

 

Coralie Généreau-Saurou only has an obligation of means for all stages of access to the Web Site, from the ordering process for shipping the package or subsequent services. The responsibility for Coralie Généreau-Saurou could not be engaged legally for any inconvenience or damage arising from the use of the Internet network, including a break in service, external intrusion or presence of computer viruses or any other incident of force majeure, according to the law and jurisprudence. In case of occurrence of an event of force majeure, the party must notify the other within fifteen (15) days from the occurrence of the event by registered letter with acknowledgment of receipt.

 

Expressly, are considered as cases of force majeure or unforeseeable circumstances, beyond those usually retained by the current case law and French courts, total or partial strikes, lockouts, riots, boycotts or other actions in the industrial field or commercial disputes, civil disturbance, insurrection, war, bad weather, epidemics, blockage of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal changes or regulations of marketing forms, computer failure, blocking telecommunications, including wired and wireless telecommunications networks, and any other case independent from the will of the parties that would prevent normal execution of the contractual relationship. All obligations of the parties shall be suspended for the duration of the force majeure event, without compensation. If case of force majeure continues for more than three (3) months, the relevant contract may be terminated automatically without compensation for either of the parties.

 

 

Pursuant to Ordinance 2005-136 of 17 February 2005 the French Consumer Code / Civil Code, all the relevant texts are reproduced here :

Art. L. 211-4. of the French Consumer Code: The seller must deliver goods in conformity with the contract and is liable for defects of conformity existing upon delivery. They also answer for the lack of conformity resulting from the packaging, from the instructions for setting or installation of the product when it was put to them by the contract or was carried out under their responsibility.

Art. L. 211-5. of the French Consumer Code: To conform to the contract, the product must: 1. Be suitable for the purpose usually associated with such a product and, if needed) corresponds to the description given by the seller and possess the qualities that they have presented to the Customer as a sample or model; b) The features that a customer can reasonably expect given the public statements made by the seller, the producer or their representative, particularly in advertising or labeling. 2. Or have the features defined by mutual agreement by the parties or be suitable for any special requirement of the customer, made known to the seller and to which the latter agreed.

Art. L. 211-12. of the French Consumer Code: The action resulting from the lack of conformity lapses two years after delivery of the goods.

Art. 1641 of the French Civil Code :The seller is bound by the legal warranty for the hidden defects of the sold good that would render it unfit for the use for which it was intended, or that would decrease this use is such way that the customer would not have acquired it or would have paid a lower price for it if they had known.

Art. 1648 paragraph 1 of the French Civil Code: The action resulting from latent defects must be brought up by the purchaser within two years after discovery of the defect.
